Required Documents for Filing a Case with the RDC

The success of a case largely depends on the completeness of the document package. Be sure to prepare originals and copies of the following: passport, residence visa, and UAE ID (Emirates ID); a valid Ejari certificate (official contract registration); the signed tenancy contract; recent DEWA bills; the security deposit receipt; copies of all cheques issued to the landlord; the owner's Title Deed and a copy of their passport; all correspondence regarding the dispute (email, WhatsApp). The absence of a key document, especially Ejari, can lead to the rejection of the claim.

Cost of Filing a Rental Dispute Case

The costs for filing a case with the RDC are clearly regulated. The main fee is 3.5% of the total annual rent under the contract. At the same time, minimum and maximum thresholds are set: a minimum of 500 dirhams, a maximum of 15,000 dirhams. For eviction cases, the maximum fee is 20,000 dirhams, and for combined claims (eviction + financial claims) — up to 35,000 dirhams. Additionally payable are: document translation into Arabic (210 dirhams per page), administrative fees (e.g., 100 dirhams for notifying the respondent), and a mandatory 10 dirham innovation fee. The final amount can vary significantly depending on the complexity of the claim.

Court Process and Alternatives

How to File a Rental Dispute Claim in Dubai
The process of filing a claim begins with preparing a complete document package. Next, you can choose one of two paths. The first is a personal visit to the RDC office in Deira, where the duty typist will help correctly formalize the application in Arabic, which is a mandatory requirement. The second path is online filing through the official DLD portal or through accredited Real Estate Services Trustees Centers. The online form requires careful completion and uploading of scanned copies of all documents. A personal visit is recommended for the first filing to promptly correct any possible errors.

Steps to Resolve a Rental Dispute

The process at the RDC is strictly structured. Step 1: Filing and Initial Hearing. After registering the claim, a date for the first hearing is set, where both parties are summoned. Step 2: Pre-trial Settlement. The judge often suggests the parties reach an amicable settlement at this stage. Step 3: Trial in the Court of First Instance. If no settlement is reached, the parties present evidence, and the judge issues a verdict. Step 4: Appeal. In case of disagreement with the verdict, an appeal can be filed with the RDC Appellate Court within 15 days (for claims exceeding 50,000 dirhams). Step 5: Cassation. For disputes valued at 330,000 dirhams or more, it is possible to appeal to the Dubai Court of Cassation within 30 days of the appellate court's decision. Step 6: Enforcement of the Decision. The winning party receives an execution order for compulsory enforcement through the official authorities.

What Happens if the Dispute is Resolved Out of Court Before the Hearing Date?

If the parties manage to reach an amicable settlement before the scheduled hearing date, the RDC process is terminated. It is necessary to notify the court of the reached agreement by providing a written settlement signed by both parties. In this case, the paid filing fee is not refunded, but you avoid further legal costs and time expenditure. Such an agreement is best certified by a notary or at the RDC itself so that it has legal force and can be enforced in case of a breach by one of the parties. This is the fastest and most economical outcome for all participants.
